Judge denies Gupta bid to toss evidence in U.S. murder plot

Prosecutors allege a confidential source introduced Gupta to an undercover officer posing as a hitman, with $15,000 delivered in New York as an advance on a $100,000 fee.

A federal judge in New York has rejected Indian national Nikhil Gupta’s effort to suppress statements and other evidence and to throw out a money-laundering count tied to an alleged plot to assassinate a U.S.-based Sikh separatist leader, clearing a significant hurdle for prosecutors as the case moves toward trial.

In a 51-page order issued Oct. 3, U.S. District Judge Victor Marrero found “there was no joint venture between authorities of the Czech Republic and the United States,” that Gupta’s statements to Czech officers “were made voluntarily,” and that he “does not have standing to challenge Count Three under the rule of speciality.”
