An Indian origin woman working in the United Kingdom has knocked on the doors of the High Court appeal tribunal in London in a prolonged battle against her firing from Accenture over alleged disability discrimination due to endometriosis.
In 2019, 41-year-old Sanju Pal was fired from her job, with the company citing underperformance due to her failure to be ready for promotion within the required timeframe, while she was suffering from endometriosis.
Endometriosis is a chronic condition where tissue similar to the uterine lining grows outside the uterus, often causing severe pelvic pain, infertility, and inflammation.
In May 2022, an Employment Tribunal ruled that Sanju Pal was unfairly dismissed by Accenture due to procedural failings, but awarded no compensation for loss of earnings, as the dismissal would likely have occurred even with a fair process.
Her condition was diagnosed in 2018 when she underwent surgery for the removal of large cysts on her ovaries. Accenture decided to terminate Pal’s employment just 3 months after her phased return to work ended.
