Amid recent challenges facing the H-1B visa program, the L-1A non-immigrant visa is emerging as a preferred alternative for US employers and Indian companies transferring talent to the United States.
Designed for executives and managers, the L-1 classification allows companies to transfer leadership from affiliated foreign offices to existing US branches. It also enables foreign companies without a current US presence to send executives specifically to establish a new office.
Unlike the H-1B, the L-1 visa does not require a labor certification for the initial petition; however, the employer must file Form I-129 with USCIS and provide substantial evidence of the qualifying relationship between the corporate entities. While L-1B specialized knowledge workers also bypass the initial labor certification, it is required later for the Green Card process.
