The U.S. Department of Homeland Security (DHS) has proposed sweeping adjustments to the fees for the Employment-Based Fifth Preference (EB-5) immigrant investor program, reducing several filing costs by up to 60 per cent while introducing new technology and integrity fees to strengthen oversight of the multi-billion-dollar visa initiative.
The proposed rule, published Oct. 23 in the Federal Register, outlines the first comprehensive restructuring of EB-5 program fees since the EB-5 Reform and Integrity Act of 2022. The move aims to ensure full cost recovery for U.S. Citizenship and Immigration Services (USCIS) while modernising program oversight through a new EB-5 Technology Fee and codified penalties for non-compliance.
