Miami Conference to offer insights into EB-5 visa program

According to USCIS data, Indian investors have steadily increased their share of EB-5 applications over the past five years, making visa availability and processing timelines central concerns for this community.

An upcoming conference in Miami will bring together law firms, financial advisors, and wealth management professionals to discuss opportunities under the United States Employment-Based Fifth Preference (EB-5) Immigrant Investor Program.

The  Sept. 18 event, jointly hosted by Saul Ewing, JTC Group, and CMB Regional Centers, is the fourth edition of the Annual Advanced EB-5 Conference, which aims to provide guidance to high-net-worth individuals on the investment-linked visa route. It will be held at the Four Seasons Hotel in Miami, Florida.

The Miami conference will bring together developers, regional center operators, lawyers, bankers, and investors to discuss the future of EB-5, including the looming sunset of the Regional Center Program and calls for its permanent reauthorization.

Organizers said panels will cover visa availability, processing delays at USCIS, reserved visa categories under the EB-5 Reform and Integrity Act, compliance strategies, and the evolving investment landscape. These issues directly affect Indian applicants, many of whom face multi-year waits for green cards despite significant investments in U.S. projects.

“EB-5 has done amazing things for this country, and it’s time for those of us in the industry to highlight the breadth and depth of the impact it has had on our local communities,” said Jill Jones, head of specialty fund administration and general counsel in the United States for JTC. “The speakers and attendees at this conference are some of the most important voices we have to show lawmakers why EB-5 matters and why the Regional Center Program deserves to be made permanent.”

The event comes amid rising participation of Indian nationals in the EB-5 program, with India now among the largest sources of applicants after China. The program enables foreign nationals to obtain permanent residency in the United States by making qualifying investments that create jobs. For the Indian diaspora, the route has grown in significance due to long waiting periods under other visa categories such as H-1B and family-based green cards.

In fiscal year 2024, some 733 EB-5 visas were issued to Indian applicants via consular processing under the “Unreserved” category, while many more secured green cards through adjustment of status in the U.S., according to Invest in the USA (IIUSA).

Meanwhile, the 2025 visa bulletin showed notable movement for Indian investors. Pre-Reform and Integrity Act (pre-RIA) applicants benefited from a 198-day advancement in the “Final Action Date” for the Unreserved EB-5 category, offering potential relief amid earlier backlogs.
