U.S. Immigration and Customs Enforcement (ICE) arrested an Indian national in Massachusetts days after local authorities released him from custody following his arrest on a charge of assault and battery with a dangerous weapon.

Dhaval Amratbhai Patel was arrested by the Worcester Police Department on May 16 after allegedly striking a man with a baseball bat during an altercation at the liquor store where he worked, according to the U.S. Department of Homeland Security (DHS).

According to a police report cited by DHS, Patel became involved in an argument with a customer that escalated when he grabbed a baseball bat and struck the man.

DHS said Patel, who was in the United States unlawfully, was released from custody without notification to ICE. Federal immigration officers subsequently arrested him on May 18.

“This illegal alien from India thought he could go around beating people with a baseball bat. Sanctuary politicians released him from jail after his arrest for assault and battery with a dangerous weapon,” Acting Assistant Secretary Lauren Bis said in a statement released on May 27.

“Sanctuary politicians must stop choosing to release criminals into our communities and work with DHS to get criminals out of country. By refusing to cooperate with ICE law enforcement, sanctuary politicians are putting the safety of their citizens at risk,” Bis added.

The department used the case to criticize Massachusetts’ sanctuary policies, arguing that a lack of cooperation between local jurisdictions and federal immigration authorities can hinder immigration enforcement efforts.
