An influential Republican Senator has introduced a bill to eliminate the exemption from the H-1B visa cap that currently applies to foreign workers employed by US colleges and universities.
Titled the Colleges for the American People Act of 2025 (CAP Act), by Senator Tom Cotton (R-Arkansas), the legislation seeks to amend the Immigration and Nationality Act to terminate the cap exemption for higher education institutions. Under current law, these institutions are allowed to hire an unlimited number of foreign workers under the H-1B visa program, as they are exempt from the annual numerical limit of 65,000 visas.
