India updates rules for foreign nationals' newborns
Rules also require notification if a child later acquires foreign nationality.

Foreign nationals whose children are born in India must report the birth to the concerned Foreigners Regional Registration Office (FRRO) or Foreigners Registration Office (FRO) within 30 days, according to an advisory issued by the Indian Bureau of Immigration.
The advisory, issued amid changes to India's immigration framework under the Immigration and Foreigners Act, 2025, outlines reporting and citizenship-related obligations for foreign nationals residing in the country.

The bureau clarified that reporting the birth is not required if one parent is an Indian citizen and the parents intend to retain Indian citizenship for the child.
The advisory also covers cases in which a child born in India later acquires the nationality of another country while residing in India. In such instances, parents must inform the concerned FRRO/FRO within 30 days of the child obtaining foreign citizenship.

The Bureau of Immigration emphasized that no individual, including a minor, can simultaneously hold an Indian passport and a foreign passport. It said compliance with reporting requirements can help avoid complications related to citizenship status, registration obligations, and travel documentation.
The advisory gains significance as FRROs and FROs serve as the primary authorities responsible for registration and immigration-related services for foreign nationals in India.
Foreign nationals staying in the country on long-term visas are already subject to registration requirements under existing immigration rules.
The Bureau of Immigration said the reporting requirements are intended to ensure compliance with citizenship and immigration regulations and urged foreign nationals residing in India to remain aware of their obligations.
